37 new High Court Judges appointed – Independence Day 2022


37 New High Court Judges have been appointed by the Government last night. This is in continuation of the appointment of 26 High Court Judges in various High Courts on Friday. With the notification of the appointments of another 11 High Court Judges in the Punjab & Haryana High Court by the government this year i.e. 2022,  so far 138 appointments in various High Courts of the country has been made thus surpassing its earlier record of 126 High Court appointments in  2016. Last year i.e. 2021, the appointment tally in High Courts was 120 in addition to 9 appointments in the Supreme Court. Thus, the entire appointment process in higher judiciary has been put on a fast track.


Yesterday’s 11 appointments in the High Court of Punjab & Haryana includes the names (1) Ms. Nidhi Gupta, S/Shri (2) Sanjay Vashisth, (3) Tribhuvan Dahiya, (4) Namit Kumar, (5) Harkesh Manuja, (6) Aman Chaudhary, (7) Naresh Singh, (8) Harsh Bunger, (9) Jagmohan Bansal, (10) Deepak Manchanda and (11) Alok Jain, Advocates as Additional Judges of that High Court for a period of two years, with effect from the date they assume charge of their respective offices.

     Following is the transcript of remarks by the Secretary for the Civil Service, Mrs Ingrid Yeung, at a media session after inspecting the first-day operation of the Children Community Vaccination Centre at Hong Kong Children’s Hospital concurrently providing vaccination service for children with the Sinovac and BioNTech vaccines this morning (August 15):

 

Reporter: Secretary, how’s the pace of young kids getting vaccinated? Because an expert said when the vaccination rate reach 20 per cent, it will go up quickly. So is the pace now quick enough? And also do you know about the procurement of BioNTech vaccines for young children? Is there a date for it?

 

Secretary for the Civil Service: I hope the pace will be quicker but I note that we have only begun the vaccination for infants aged 6 months to 3 years old for less than two weeks. Right now we have more than 3 000 infants between this age bracket who have got vaccinated. I hope the pace will quicken. But I am confident that as school opens, as many more schools organise outreach services for their students, and as parents become more aware of the benefit of having the vaccination, the percentage will go up. We are still discussing with the pharmaceutical company that produces BioNTech vaccine for the infant formula of the BioNTech vaccine, procurement of this vaccine for use. When we have further news, we will let everybody know.

 

Reporter: Would it be illegal to create a private social group like the “Civil Service Secrets” to express their dissatisfaction about the Government, and what is the criteria to…would it be illegal for that discussion?

 

Secretary for the Civil Service: The Secretary for Security has clearly explained yesterday that simple criticism of the Government would not be illegal. For the civil service, we have plenty of established channels for colleagues to reflect their views to the management. We are very open to colleagues’ views. In fact, I do have regular meetings with staff unions from time to time and I received a lot of criticisms about government policies, human resources management policies, etc. Government departments and bureaux also have their own departmental liaison channels with civil servants. So I don’t think there is no channel for civil servants to express their views except on private social media platforms. And even on private social media platform as long as the information is not confidential and as long as it is a normal sort of criticism of government policies, it is no problem for civil servants to express them. Thank you.

Hong Kong – Two illegal workers jailed

Two illegal workers jailed

     Two Bangladeshi illegal workers holding recognisance forms were jailed by Shatin Magistrates’ Courts on August 11 and today (August 15).



     During an anti-illegal worker operation conducted on November 29 and December 28 last year, Immigration Department (ImmD) investigators raided Yuen Long and Kwai Chung Districts. Two Bangladeshi males, aged 35 and 39, were arrested while working as food delivery workers. Upon identity checking, they produced for inspection recognisance forms issued by the ImmD, which prohibit them from taking employmemnt. Further investigation revealed that they were non-refoulement claimants.



     The two illegal workers were charged at Shatin Magistrates’ Courts on August 11 and today with taking employment while being a person in respect of whom a removal order or deportation order was in force. After trial, they were each sentenced to 22 months and 14 days’ imprisonment.



     The ImmD spokesman warned that, as stipulated in section 38AA of the Immigration Ordinance, an illegal immigrant, a person who is the subject of a removal order or a deportation order, an overstayer or a person who was refused permission to land is prohibited from taking any employment, whether paid or unpaid, or establishing or joining in any business. Offenders are liable upon conviction to a maximum fine of $50,000 and up to three years’ imprisonment.



     The spokesman reiterated that it is a serious offence to employ people who are not lawfully employable. Under the Immigration Ordinance, the maximum penalty for an employer employing a person who is not lawfully employable, i.e. an illegal immigrant, a person who is the subject of a removal order or a deportation order, an overstayer or a person who was refused permission to land, has been significantly increased from a fine of $350,000 and three years’ imprisonment to a fine of $500,000 and 10 years’ imprisonment to reflect the gravity of such offences. The director, manager, secretary, partner, etc, of the company concerned may also bear criminal liability. The High Court has laid down sentencing guidelines that the employer of an illegal worker should be given an immediate custodial sentence.



     According to the court sentencing, employers must take all practicable steps to determine whether a person is lawfully employable prior to employment. Apart from inspecting a prospective employee’s identity card, the employer has the explicit duty to make enquiries regarding the person and ensure that the answers would not cast any reasonable doubt concerning the lawful employability of the person. The court will not accept failure to do so as a defence in proceedings. It is also an offence if an employer fails to inspect the job seeker’s valid travel document if the job seeker does not have a Hong Kong permanent identity card. Offenders are liable upon conviction to a maximum fine of $150,000 and to imprisonment for one year. In that connection, the spokesman would like to remind all employers not to defy the law by employing illegal workers. The ImmD will continue to take resolute enforcement action to combat such offences.



     Under the existing mechanism, the ImmD will, as a standard procedure, conduct initial screening of vulnerable persons, including illegal workers, illegal immigrants, sex workers and foreign domestic helpers, who are arrested during any operation with a view to ascertaining whether they are trafficking in persons (TIP) victims. When any TIP indicator is revealed in the initial screening, the officers will conduct a full debriefing and identification by using a standardised checklist to ascertain the presence of TIP elements, such as threats and coercion in the recruitment phase and the nature of exploitation. Identified TIP victims will be provided with various forms of support and assistance, including urgent intervention, medical services, counselling, shelter, temporary accommodation and other supporting services. The ImmD calls on TIP victims to report crimes to the relevant departments immediately.

Bloomberg Gender-Equality Index Interest Increases Globally

Companies rush to participate before the September 30 deadline

The number and diversity of companies that have applied to be included in the 2023 Bloomberg Gender-Equality Index (GEI) has risen sharply ahead of the September 30 deadline, Bloomberg announced today.


Publicly traded companies voluntarily participate in the GEI, which analyses the performance of their diversity and equality policies compared to their peers. The 2022 GEI listing included 418 companies from 11 different sectors in 45 countries. This year, Bloomberg is already seeing an increase in participants and the amount of details being disclosed over last year.


GEI data so far shows:

  • the number of accounts registered has risen 40% in the U.S., 39% in Europe, Middle East & Africa, 18% in Asia Pacific and three percent in Latin America
  • new country participants include Colombia, Peru, Uruguay, and Pakistan
  • while financial companies have traditionally led the list, now companies in the aerospace, pharmaceutical and technology sectors are participating

“We are gratified to see so many more companies use the GEI to identify and strengthen their policies regarding equal pay and gender pay parity,” said Patricia Torres, Global Head of Bloomberg’s Sustainable Finance Solutions, which includes the GEI. “This transparency helps companies attract employees and gives investors the data they need to make decisions.”


The GEI evaluates companies on five key pillars:

  1. Leadership and Talent Pipeline
  2. Equal pay and gender pay parity
  3. Inclusive Culture
  4. Anti-Sexual Harassment Policies
  5. External Brand

For the 2023 evaluation, companies asked that Bloomberg add two other areas for exploration — LGBTQ+, race and ethnicity. Disclosure of this data will begin in the US and UK markets; these questions are optional and will not be scored.


Companies participate voluntarily at no cost via the Bloomberg GEI website. The deadline for submission to the 2023 GEI is September 30, 2022. After submitting data, Bloomberg’s GEI team analyses the data and provides the company a scorecard based on the methodology. The team will review the results with the companies, so they know how they were scored and why, prior to the announcement of the GEI results in January 2023.


“Companies can also use the GEI as an internal worksheet,” Torres added. “They can go online, without obligation, and see what the methodology entails. This is helpful in enhancing their gender-equality programs.”

Flex Move Screen allows users to adjust screen size between 55- and 27-inches, change the screen position and even switch the screen ratio between 16:9, 21:9 and 32:9 — all with just one touch of Ark Dial. This freedom is not only horizontal but also vertical position, giving users even more control of the viewing experience. Multi View allows users to use the large screen to its full potential by displaying up to four screens all at once while horizontal, or three while in Cockpit Mode. This eliminates the need for multi-monitor setups, so gamers can enjoy a clutter-free environment.


Game Bar3 is a powerful tool enabling gamers to quickly and easily view their gaming status and control important settings without ever needing to leave the game screen.
