     Following is the speech by the Secretary for Transport and Logistics, Mr Lam Sai-hung, at the 38th Anniversary Cocktail of the Institute of Seatransport today (November 21):


 


Simon (Chairman of Institute of Seatransport, Mr Simon Cheng), distinguished guests, ladies and gentlemen,


 


     Good evening. It gives me great pleasure to be here today to celebrate with you all the 38th anniversary of the Institute of Seatransport during the Hong Kong Maritime Week.



     Since its inception in 1984, the Institute of Seatransport has all along been our close partner in promoting Hong Kong’s maritime and port industry on a variety of occasions, and in particular, during the Hong Kong Maritime Week. The Government is pleased to have the unfailing support from the Institute. The Institute has become a more and more important maritime organisation which consists of seatransport professionals of different disciplines. The Institute also provides newcomers in the industry an excellent platform where they can build their network and acquire professional knowledge from industry veterans. We are in particular thankful for the Institute’s efforts in fostering the knowledge exchange within the industry and nurturing new talents.



     With the staunch support from the industry, enterprises, institutions and organisations, the Hong Kong Maritime Week has come to its sixth edition. This year, over 40 activities will be staged, ranging from industry-led seminars to family-oriented events and site visits. The Week will serve to promote the Hong Kong maritime industry as a strong cluster and to raise the public’s interest in being devoted to the industry. 



     I am particularly grateful to the Institute for being very supportive to the Hong Kong Maritime Week. Apart from this cocktail reception tonight, the Institute is also co-organising another two events in the Hong Kong Maritime Week, including the seminar on upcoming energy regulations in 2023 with the Hong Kong Shipping Circles Association, and the one-day masterclass on marine insurance co-hosted with Asia Maritime Adjusting. These events are excellent examples of the Institute’s great efforts in promoting the exchange of professional knowledge within the Hong Kong shipping industries.



     Indeed, the Government shares the same vision with the Institute to nurture the talent pool and to raise the professionalism of the personnel in the maritime industry. To attract our young generation to join the industry and to maintain a maritime talent pool, we have put in place the $300 million Maritime and Aviation Training Fund more than eight years ago. By the end of September this year, the number of beneficiaries of the Fund has already exceeded 14 800. As highlighted in the Chief Executive’s 2022 Policy Address delivered last month, the Government will launch a Maritime Services Traineeship Scheme next year to provide traineeship for young people who aspire to a career in maritime law. Furthermore, the Government has made tireless efforts to encourage more high-value-added maritime services to come to Hong Kong. One example is the introduction of our tax concessions for ship lessors, marine insurers, and most recently, ship agents, ship brokers and ship managers. We will continue to work with the industry to pursue different policies to consolidate our position as an international maritime centre.

     Following is the speech by the Deputy Secretary for Justice, Mr Cheung Kwok-kwan, at the 35th Anniversary Gala Dinner of School of Law of City University of Hong Kong today (September 24):



Mr Lester Huang (Council Chairman of the City University of Hong Kong), Professor Way Kuo (President of the City University of Hong Kong), Professor Lin (Acting Dean of the School of Law of City University of Hong Kong), distinguished guests, ladies and gentlemen,



     Good evening. It gives me great pleasure to join you tonight to celebrate the 35th Anniversary of the School of Law of the City University of Hong Kong, which is also my alma mater. As an alumnus, I would like to say a few words on the immense opportunities lying ahead for Hong Kong legal profession.



     Underpinned by our robust legal system, Hong Kong has always been an international legal services and dispute resolution hub, with a diverse pool of legal talents. More importantly, Hong Kong has been enjoying the unique advantage under the principle of “one country, two systems”.



Common law system



     Hong Kong is the only common law jurisdiction within our country. In President Xi’s speech made on July 1, President Xi twice recognised that the common law system of Hong Kong is one of its irreplaceable edges. The central government fully supports Hong Kong in its effort to maintain the common law system, so as to expand and facilitate its exchanges with the world. Certainly the “common law system” encompasses not only legal rules or case precedents, but also our legal profession, our law schools which have nurtured so many generations of young legal talents. You have all contributed to this important achievement and will continue to play an integral part of Hong Kong’s further development as an international legal services and dispute resolution centre.



Immense opportunities ahead



     As remarked by President Xi, “Hong Kong’s close connection with the world market and strong support from the motherland are its distinctive advantages”. We must maintain Hong Kong’s distinctive status; and Hong Kong has all along been enjoying staunch national support.



     For instance, the National 14th Five-Year Plan, as well as the Outline Development Plan for the Greater Bay Area explicitly support Hong Kong’s development into a centre for international legal and dispute resolution services in the Asia-Pacific region. Coupled with other national development initiatives like the Belt and Road, there are immense opportunities for the legal and dispute resolution profession in Hong Kong.



     We must grasp the opportunities proactively by enhancing the co-operation and collaboration between the two legal systems in the Mainland and Hong Kong. In this regard, it would be timely for me to highlight a few areas which might be of particular relevance for Hong Kong lawyers.



     You might have heard about the GBA Legal Professional Examination (GBA Exam), which has been successfully held in the last couple of years. The GBA Exam facilitates the flow of legal talents within the GBA and enables qualified Hong Kong legal practitioners to provide legal services in the GBA on specified civil and commercial legal matters.



     To enhance and facilitate the provision of legal services within the GBA by the relevant Hong Kong legal practitioners, the Department of Justice (DoJ) and the Supreme People’s Court had also collaborated to provide practical training for those who have passed the GBA Exam, so as to enhance their practical knowledge on Mainland courts’ handling of different areas of civil and commercial matters.



     The DoJ has also stepped up its efforts to foster closer legal, mutual legal assistance in civil and commercial matters with the Mainland. Over the years, nine arrangements with Mainland authorities on matters relating to mutual legal assistance has been concluded, such as (1) the Arrangement for Mutual Service of Judicial Documents in Civil and Commercial Proceedings (2) the Arrangement Concerning Mutual Enforcement of Arbitral Awards and (3) the Arrangement on Mutual Taking of Evidence in Civil and Commercial Matters.



     These Arrangements are working well and play an important role, especially the arrangement on mutual enforcement of arbitral awards. Not only does it enhance exchanges between the arbitration and legal sectors of the two jurisdictions, the arrangement also helps Hong Kong enhance its status as an international legal and dispute resolution centre in the Asia-Pacific region.



     Indeed, upon the signing of the Arrangement on Interim Measures in Aid of Arbitral Proceedings between Mainland and Hong Kong in 2019, Hong Kong becomes the first jurisdiction outside the Mainland where, as a seat of arbitration, parties to arbitral proceedings administered by the six eligible arbitral institutions would be able to apply directly to the Mainland courts for interim measures.



     For mediation, the three legal departments in the GBA Joint Conference, ie, Guangdong, Hong Kong and Macao, have agreed on common accreditation standards and code of conduct best practice of the GBA mediators. They are also actively exploring other collaborations in different aspects such as arbitration, capacity building, professional exchanges etc.



Legal education



     Law schools certainly play an important role in equipping the future generations of our legal community in grasping the immense opportunities brought by the national initiatives, in particular the GBA development and the Belt and Road Initiative.



     To this end, the School of Law of the City University of Hong Kong has always been a pioneer in conducting research of Chinese and comparative law, providing high quality legal education of Chinese law, and offering joint programmes to train Chinese judges.



     I also take this opportunity to congratulate the Public Law and Human Rights Forum of the School of Law which had successfully organised its first legal forum addressing the conflicts of law, legal co-operation and connection of rules within the GBA, while the same was met with overwhelming response.



     The DoJ looks forward to collaborating with key stakeholders from the academic sector in providing comprehensive legal education, exchanges and capacity building activities to both law students and practitioners. I believe all of these initiatives will substantially enrich the capacities of both our law students and legal professionals, of Hong Kong as well as the Mainland.

     Tonight we celebrate the 35th Anniversary of the School of Law. On this very special occasion, I would like to wish the Gala Dinner and other celebratory events fruitful and memorable. Thank you.

350th Anniversary of Peter the Great’s Birth: the permanent display of Russian Culture in the First Half of the 18th Century



 The display is housed in the part of the Winter Palace overlooking the main courtyard that once contained the childhood rooms of Emperor Nicholas I’s sons Konstantin, Nikolai and Mikhail. The Gazprom public joint-stock company acted as general sponsor for the creation of the new display.


The opening of the first phase of the display is timed to coincide with some notable anniversaries – 300 years since the proclamation of the Russian Empire and also 300 years since the signing of the Treaty of Nystadt that brought the Northern War to an end and formally returned lands lost in previous Russo-Swedish wars. At the same time, the display will be the start of a large-scale project devoted to the 350th anniversary of the birth of Peter the Great, which will take place in May 2022.


The display contains many paintings, sculptures and works of applied art, scientific devices and instruments that came from the palace collections of Peter the Great, his niece Empress Anna Ioannovna and his daughter, Empress Elizabeth. The exhibits placed in the halls of the first phase are devoted to the personality of Peter himself, the history, culture and art of Russia at the time of the sweeping reforms that he introduced.


Hall 156 (the Rotunda) tells about Russia’s victories in the Northern War (1700–21) that ended 300 years ago with the signing of the Treaty of Nystadt. In the centre of the hall is a model of the Triumphal Column glorifying the success of the Russian forces. On display alongside are the painting of The Battle of Poltava that Peter the Great commissioned from Louis Caravaque and a bronze bust of the first Russian emperor created by the sculptor Bartolomeo Carlo Rastrelli. Hall 157 contains paintings by Russian artists of Peter’s day and foreigners who worked in Russia. They are mainly portraits of members of the Emperor’s family and prominent statesmen. One showcase holds a unique wax bust that recorded Peter I’s appearance with documentary precision. The exhibits in Hall 158 come from the memorial collections of the “Study of Peter the Great” and “Gallery of Peter I”. Here visitors can see items made by Peter himself, the Tsar’s costumes, walking sticks, seal and other personal belongings of the Emperor.


On 28 December the opening ceremony will be available for viewing online, while on 29 December the curator Natalia Bakhareva, a senior researcher in the Department of the History of Russian Culture, will conduct the first online guided tour.
